In April 2006, the Federal
Financial Institution Examination Council (FFIEC) Task Force on Consumer Compliance approved amendments to the interagency Fair Credit Reporting Act (FCRA) examination procedures. The amendments update section 604(g) of Module 2 of the interagency examination procedures that were released in November 2005 (OCC Bulletin 2005-38). The amendments, included in the attached procedures, address provisions in the medical information rule (12 CFR 41 Subpart D) that were effective April 1, 2006.
Further amendments to the attached
procedures are planned following publication of final rules that
address affiliate marketing opt-out and risk-based pricing under the
Fair and Accurate Credit Transactions Act of 2003.
The OCC plans to incorporate the amended
examination procedures in an update to the Comptroller’s
Handbook
series when all of the
amendments are completed. Until the revised handbook is issued,
examiners will use the attached FCRA examination procedures.
